Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and [WA/ASIC Business name (ABN…) here] (Western Australia, Australia) ("Revirium", "we", "us") governing your use of the Revirium app for iPhone and Apple Watch (the "App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 16 years old, or the age of digital consent where you live, to use the App. By using the App you represent that you meet this requirement.
2. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by the App Store Terms of Service and these Terms. You may not copy, modify, reverse-engineer, resell or distribute the App except as allowed by law.
3. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. You may delete your account at any time from within the App.
4. Health & medical disclaimer — please read
Revirium is a general health, fitness and wellness tool. It is not a medical device and does not provide medical advice, diagnosis or treatment. The insights, trends, scores and recommendations it provides are for informational purposes only and may be inaccurate or incomplete.
- Always consult a qualified healthcare professional before starting, changing or stopping any exercise, training, nutrition or health program.
- Never disregard professional medical advice or delay seeking it because of something you read or saw in the App.
- If you think you may have a medical emergency, call your local emergency number immediately.
- You use the App and act on its information at your own risk. Physical activity carries inherent risks of injury.
5. Acceptable use
You agree not to misuse the App, including by: violating any law; attempting to gain unauthorized access; interfering with the App's operation or security; uploading false, harmful or infringing content; or using the App to harm yourself or others.
6. Your content and data
You retain ownership of the content and data you create in the App. You grant us the limited license needed to store, process and display it to operate the App for you. Our handling of your personal and health data is described in our Privacy Policy.
7. Third-party services
The App works with services we do not control, including Apple Health (HealthKit), Sign in with Apple, and Supabase (our backend provider). Your use of those features is also subject to their respective terms and privacy policies. We are not responsible for third-party services.
8. Purchases
The App is currently free to use. If we add in-app purchases or subscriptions in the future, those purchases will be processed by Apple and governed by additional terms presented at the time of purchase.
9. Intellectual property
The App — its design, software, text and branding ("Revirium" and associated marks) — is owned by us or our licensors and protected by law. These Terms grant you no rights to our intellectual property except the limited license in Section 2.
10. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that data or insights will be accurate. Nothing in these Terms excludes rights or guarantees you have under the Australian Consumer Law that cannot lawfully be excluded.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed AUD $100. Some jurisdictions (including Australia) do not allow certain limitations, so some of these may not apply to you.
12. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your misuse of the App or violation of these Terms, to the extent permitted by law.
13. Termination
We may suspend or terminate your access if you violate these Terms or to protect the App and its users. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination (e.g. 4, 9–12) will survive.
14. Changes to these Terms
We may update these Terms from time to time. We will update the date above and, for material changes, provide notice in the App. Continued use after changes means you accept them.
15. Governing law
These Terms are governed by the laws of Western Australia, Australia, without regard to conflict-of-laws rules. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia.

Appendix A — Apple-required EULA terms
Included as required when these Terms serve as the custom EULA in App Store Connect.
- Acknowledgement. These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for the App and its content.
- Scope of license. The license granted is limited to a non-transferable license to use the App on any Apple-branded products you own or control, as permitted by the App Store Terms of Service.
- Maintenance and support. We are solely responsible for any maintenance and support for the App. Apple has no obligation to provide any maintenance or support.
- Warranty. We are solely responsible for any product warranties, express or implied. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs or expenses attributable to a warranty failure are our responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims relating to the App or your use of it, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer-protection or privacy law.
- Intellectual property rights. In the event of any third-party claim that the App infringes intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
- Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Questions, complaints or claims about the App should be directed to contact@revirium.com.
- Third-party terms. You must comply with applicable third-party terms when using the App.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
